Judge bravely refuses to blindly accede to order by her boss, the AG

Update 12.15pm, 10/9/08 – This addition is inspired by Pratamad. As many know by now, the Sessions Court Judge who has been hearing Anwar’s case was instructed by the Attorney General, who is technically her boss (since she’s only a sessions court judge, not high court), to transfer the case to the High Court.

Rather than be a yes-woman, the judge has set Sept 4 to hear arguments from both prosecution and defence as to the validity of transferring the case to the High Court. Score one (or two, by now) for objectivity :)

Update 10.30, 10/9/08 – ADILsms tells us that the case has been postponed to the 24th of September, when the defence will argue against transference of the case to the High Court.

Original Post: Anwar, Court, Jail -

Technically, there is a chance that they’ll put Anwar behind bars in a few hours. What will come to pass or not, we don’t know yet, but we’ll be watching in solidarity with prayers for justice.

I wanted to note earlier that the three lawyers who had been kind enough to help out with my case last year are all on Anwar’s defence theme – I feel so lucky :)

Going into tomorrow and next week, I also read with interest RPK’s inspired recent piece. That’s the kind of solidarity that can save us.

    what evidence have they got hasn’t the noble doctor from Pusrawi Hospital fired his initial findings. Even if they still instill there’s something to be heard and deliberated I am afraid its going to be a tight slap on our judicial integrity or the learned judge might throw it on the SCOUNDRELS.

    Perhaps the Judge is building the trust of the defense team and the genral public/observers so that we will think that she is not going to be another “Augustine Paul”. However, when push comes to shove, she could well show her true colours.

    If she is really neutral and willing to be objective while presiding over this case, then I fear she may go the way of Private Investigator Bala.

    I wonder if he and his family have all been blown up by C4 or whether they are responding “positively” to the indoctrination they must be currently put through to make them realise that “What BN says is true. And Anwar is bad”.

    Im surprised there is no more interest in the whereabouts and condition of Bala & his family.

    I suppose the attempt to transfer the case to the High Court is to appoint a more compliant judge to hear the case. apparently, judge Komathy is too fair-minded for them.

    Anwar should fight this transfer tooth and nail. His freedom depends on it.

    Let’s all pray that Judge Komathy prevail and hear the case in her court.

    I don’t think the politicos have any hold on judge Komathy, that’s why they are desperate to transfer the case to the High Court. Augustine Paul was different. He was handpicked for the trial – a judicial commissioner promoted to High Court judge just to hear DSAI’s case and now he’s promoted again to Federal Court.

    I believe Judge Komathy will be fair which means the case doesn’t stand a chance but first the defense has to fight the transfer order.

    Will Judge Komathy be strong enough to insist that the case be heard in her court? Is there any precedent of a judge ruling against the AG’s order?

    I believe she can rule against the transfer or otherwise why would she set a hearing date? Let’s all hope she makes the right decision or the alternative is too terrible to contemplate.
