Anwar charged for consensual sex, not sexual assault – if “proven,” will Saiful be charged?

By now you obviously know about Anwar being allowed bail (RM20k), court date of Sept 10th, thus he will indeed be on the ground in Permatang Pauh. You probably also know about the latest statutory declaration making the rounds.
What’s the early surface analysis?
Obviously, better Anwar out than in, so kudos to the judiciary for this tiny first step. I think the early court date is also a good thing.
Note as well that the charge was in the end, the original time mentioned – 26th June, between 3.01 pm and 4.30 pm at Desa Damansara.
Also, apparently, the charge under Section 337B was for consensual sex, not for sexual assault. Which means that if Anwar is guilty, Saiful is guilty. I wonder how the latter feels about that.

Dr. Osman’s statutory declaration is certainly very interesting, and bears close scrutiny. It speaks of highly irregular harrasment, intimidation and possible fabrication.
I expect it to be used thoroughly in the case. As for the public? I get this strange feeling that the ‘undecided’ or ’swingable’ ground with regards to public opinion on this matter is shrinking fast.
A fairly cocky Abdullah seems to be confident in the evidence the police have (more on Anwar’s recent redirected outlash against Abdullah soon I hope). Well, I guess only time will tell. This whole premise of “The authorities can’t possibly be that stupid” is probably not, how shall I say, a consistently applicable principle in Malaysia’s circumstances.

But Dollah said he was raped? What happened? Ha ha ha! The AMENO hordes are in a tight spot and the nation is demanding honest answers. Well, since it was “consensual”, how comes saiful didn’t make it to the courts to answer charges? I think this sandiwara was basically meant to “busy” Anwar for a while and deflect attention rather than them having any case. Anwar should tell off Dollah and tear him apart. I did not expect that the case allow bailout. Totally unexpected. Now the government is playing fair games with DSAI. Thats so kind of the authorities. Maybe the government is showing to the public that they are dealing with the case in a professional and a fair to DSAI.

They have to drop the sexual assault charge, simply because,
they have not nothing concrete, except fabricated evidence…which will not hold water.

Firt of all kudos to the upright Madam Judge in the Sessions Court for judiciously excercising her discretion in allowing bail to DSAI this morning. What is expected of our judicial officers naturally and expectedly has now become the opposite. Somehow things are a changing if people like Judge Komalati and Dr Osman stand firm and tall in their calling and not swayed by fear or favour. There is hope for al of us.

The police and the AG are really stupid if they think that a charge under 377(b) of the Penal Code can be made out against DSAI when the first mediacal report shows no prima facie evidence of penetration by any object in Saiful arse. What really irks me is that Saiful’s police report is stated that he was forcibly sodomised. Therefore on which report does the police/AG rely on to prefer a charge of voluntary sodomy? Is there another police report? Is the police admitting that Saiful has lodge a false report? Will Saiful be charge for that? Will the police arrest and treat him like they did to Anwar?
This stupid Saiful may not be aware that the section also implicates him and that he may also goes to jail.
Presently he is blurred by the ringgit floating infront of him.His lawyer would not give a damn to advice saiful because he too wants to grab the floating ringgits!

One minor point: it is personal bond of RM20k, not a bail, set by the presiding judge. There is obviously some significance legally, which is not my cup of tea. And no surety and passport not surrendered. Judge concerned is SM Komathi Suppian. Kudos!

By charging Anwar for the offence of consensual anal sex with a person of the same sex, the prosecution is in effect prosecuting him for the “crime of homosexuality”.
