update 12.50am: KeADILan’s SMS service says that Anwar recently came into possession of documents proving Musa Hassan and Gani Patail fabricated evidence in ‘98. Not sure about the source, just passing on what I got.
Who knew the government would be so amazingly stupid as to think that this, of all tricks, would appear credible to the world – least of all to Malaysians – at a time like this.
BN has failed to learn the single most important lesson of March 8th: the rakyat is not stupid.
Is it not the height of desperation to have the most ludicrous of accusations against Anwar, already recently proven in court to be absolute bullshit, resurface at a time when:
a) he has publicly declared that he has the MP’s he needs to form the government
b) SAPP has just made their declaration
c) BN’s popularity is at its lowest levels in history
d) RPK made a statuary declaration about Rosmah being at the scene of Altantuya’s murder
e) A big anti fuel hike protest was set for 6th July
clearly means that obviously, something is going on that stinks.
No comment for now on the individual who made the accusations, or the circumstances surrounding that accusation. I’m just going to follow the developments closely first.
Be on your watch, Malaysia, the soul of our nation may be hanging in the balance.

The police report lodged against me earlier today is a complete fabrication. I believe we are witnessing a repeat of the methods used against me in 1998 when false allegations were made under duress. This is clearly a desperate attempt by the Barisan Nasional regime to arrest the movement of the Malaysian people towards freedom, democracy and justice.
The report has been organized by interested parties to attack me in retaliation for evidence I have recently obtained implicating IGP Musa Hassan and the AG Gani Patail in misconduct including fabrication of evidence in the cases launched against me in 1998-1999. This vile attack will not prevent me from releasing this dossier to the public.
I urge the Malaysian people to stand against the repressive forces that will be unleashed by the government in the coming days and weeks. We expect the media, the judiciary and the police force to all come under the direct and unchecked control of the executive.
My fellow Malaysians – we took a bold step forward on March 8th towards a new dawn for freedom and justice for all of our citizens. This people’s movement for change must go on with all of our strength and conviction.

When Anwar is released, it is called justice. But when a guy makes a police report, he is straight away condemned as a liar and it is called a political conspiracy. How convenient.

I say let DSAI release the evidence that the current IGP and AG fabricated evidence in 1998. Then we would know whether it is the police who sodomised the poor guy and force him to make a report against DSAI. After all, recent developments showed us that the police force people to perform oral sex. One young police officer also went as far as raping a girl in the police station.

In this judgment, Dato’ Seri Anwar bin Ibrahim will be referred to as “the first appellant” and Sukma Darmawan Sasmitaat Madja will be referred to as “the second appellant”.
The first appellant was charged with an offence punishable under section 377B of the Penal Code.
The second appellant was charged with two offences. The first charge is for abetting the first appellant in the commission of the offence with which the first appellant was charged. The second charge is similar to the charge against the first appellant i.e. under section 377B of the Penal Code.
Both the appellants were tried jointly. The first appellant was convicted and sentenced to nine years imprisonment commencing from the expiry of the sentence he was then serving in the first trial. High Court Kuala Lumpur Criminal Trial No. 45-48-1998 (1999)2 M.L.J. 1 (H.C), (2002)2 M.L.J. 486 (C.A.) and (2002) 3 M.L.J. 193 (F.C.)). The second appellant was convicted on both charges and sentenced to six years imprisonment and two strokes for each charge with the sentences of imprisonment to run concurrently. For the judgment of the High Court in the present case, see (2001) 3 M.L.J. 193.
They appealed to the Court of Appeal. Their appeals were dismissed – see (2004) 1 M.L.J. 177.
They appealed to this court and this is the majority judgment of this court.
Section 87(3) of the Courts of Judicature Act 1964 (“CJA 1964”) provides that a criminal appeal to this court “may lie on a question of fact or a question of law or on a question of mixed fact and law.” The position is the same as in the case of the Court of Appeal hearing an appeal from a trial in the High Court as in this case – see section 50(3) CJA 1964.
To summarise our judgment, even though reading the appeal record, we find evidence to confirm that the appellants were involved in homosexual activities and we are more inclined to believe that the alleged incident at Tivoli Villa did happen, sometime, this court, as a court of law, may only convict the appellants if the prosecution has successfully proved the alleged offences as stated in the charges, beyond reasonable doubt, on admissible evidence and in accordance with established principles of law. We may be convinced in our minds of the guilt or innocence of the appellants but our decision must only be based on the evidence adduced and nothing else.”
