Say No to the Spectre of May 13


- Chew Mei Fun MP must retract her fear-mongering statement and apologize
We, the undersigned civil society groups and concerned citizens of diverse ethnic, religious and cultural backgrounds, stress that all Malaysians have the right to choose their representatives and the government in a free, fair and clean election. No individual politician or political party should resort to threats or intimidation to influence the voter’s decision.
We lament that Datin Paduka Chew Mei Fun, MCA MP for Petaling Jaya Utara, as reported in the China Press on January 21 (Monday), has conveyed this fear-mongering message to the public: “If there is insufficient Chinese representation in the Barisan Nasional, it is not a good thing, the Chinese community cannot afford another May 13 incident.

The May 13 ethnic riot in 1969 was a dark chapter in Malaysia’s political history where political violence and manipulation overshadowed the democratic process as well as the voice of the people. Invoking the bitter memories of this tragic incident for political gain is a huge insult to those who died, the surviving victims and their families. This veiled threat to voters not to support the opposition parties is shameless and unbecoming of a responsible political leader.

If Chew is aware of certain quarters planning to use violence in response to a certain electoral outcome, she who has been speaking tirelessly on public safety should lodge a police report immediately and assist in the police investigation.
If she is merely speculating, we are truly disappointed that she has stooped so low in fishing for support. Politicians should not behave like gangsters. They should not use the threat of violence to solicit vote, as gangsters do to extort money.

By making this statement, Chew has in fact violated Section 9 (1) of the Election Offences Act 1954:

    Undue influence
    9. (1) Every person who, before, during or after an election, directly or indirectly, by himself or by any other person on his behalf, makes use of or threatens to make use of any force, violence, or restraint, or inflicts or threatens to inflict, by himself or by any other person, any temporal or spiritual injury, damage, harm, or loss upon or against any person in order to induce or compel such person to vote or refrain from voting, or on account of such person having voted or refrained from voting, at any election, or who by abduction, duress, or any fraudulent device or contrivance impedes or prevents the free exercise of the franchise of any elector or voter, or thereby compels, induces, or prevails upon any elector or voter either to give or refrain from giving his vote at any election, or who directly or indirectly interferes or attempts to interfere with the free exercise by any person of any electoral right shall be guilty of the offence of undue influence.

While waiting for the Election Commission to investigate and lodge a police report, we call upon Chew to do the honorable thing. She should retract her statement and apologize unreservedly for her fear-mongering act. She must condemn unreservedly the use of political violence in Malaysia.

Voters must be assured of their right to vote for any candidate or party of their choice in an environment that is free from fear and intimidation.

We also call upon the Prime Minister Dato’ Seri Abdullah Badawi to disassociate his administration and party from Chew’s fear-mongering statement and condemn unreservedly the use of threats and intimidation on voters.

We must not let Malaysia become a failed state where political violence political violence by state and non-state actors rule. We must not allow any party to ‘play with fire’. We categorically reject anyone who uses the spectre of May 13 as a bogeyman to threaten Malaysians.

All civil society organisations in support of democracy may endorse this statement by displaying a copy of this statement on their premises, vehicles or the front page of their blogs or websites, until Chew retract the statement and apologizes.

- Ahli Parlimen Chew Mei Fun mesti tarik balik and minta maaf atas kenyataan beliau

Kami, badan-badan masyarakat madani dan warganegara prihatin yang berbagai kaum, agama dan latarbelakang, menegaskan bahawa semua anak Malaysia mempunyai hak untuk memilih wakil rakyat dan kerajaan malalui pilihanraya yang bebas, adil dan bersih. Tiada ahli politik atau parti politik harus menggunakan ugutan atau ancaman untuk mempengaruhi para pengundi.

Kami kesal bahawa Datin Paduka Chew Mei Fun, Ahli Parlimen untuk Petaling Jaya Utara (MCA), seperti yang dilaporkan oleh China Press pada Januari 21 (Isnin) telah mengeluarkan kenyataan yang bersifat ugutan atau ancaman: “Jika tiada perwakilan Cina yang mencukupi dalam BN, ia bukanlah sesuatu perkara yang baik, komuniti Cina tidak sanggup menanggung lagi satu insiden Mei 13.

Rusuhan kaum Mei 13, 1969 sememangnya suatu episod gelap dalam sejarah Malaysia di mana keganasan dan manipulasi politik telah menindas proses demokratik dan suara para pengundi. Pembangkitan insiden pahit ini demi kepentingan politik bersifat menghina mangsa yang terkorban, mangsa yang terselamat dan juga keluarga mereka. Tindakan Chew yang bertujuan menjadi amaran kepada pengundi supaya tidak menyokong parti pembangkang adalah perbuatan keji dan tidak mempamerkan sifat seorang pemimpin yang berwibawa.

Sekiranya Chew sememangnya mengetahui apa-apa maklumat tentang pihak tertentu yang berhasrat untuk menggunakan keganasan akibat keputusan pilihanraya yang tidak memuaskan, beliau yang selama ini giat membangkit isu keselamatan awam patut serta-merta membuat laporan polis dan membantu dalam penyiasatan polis.

Sekiranya beliau sekadar berspekulasi, kami berasa amat kecewa kerana beliau sanggup melakukan apa saja untuk mengumpan undi. Ahli politik tidak patut berkelakuan selolah-olah anggota kongsi gelap. Mereka tidak patut menggunakan keganasan sebagai ancaman untuk meraih undi sepertimana anggota kongsi gelap memeras wang.

Pada hakikatnya, Chew telah melanggar Seksyen 9 (1) Akta Kesalahan Pilihanraya 1954:

9. (1) Tiap-tiap orang yang, sebelum, semasa, atau selepas sesuatu pilihan raya, secara langsung atau tidak langsung, dengan sendiri atau melalui mana-mana orang lain bagi pihaknya, menggunakan atau mengancam hendak menggunakan apa-apa kekerasan, keganasan atau halangan, atau yang mengenakan atau mengancam hendak mengenakan, dengan sendirin atau melalui mana-mana orang lain, apa-apa bencana, kecacatan, kerosakan atau kerugian keduniaan atau kerohanian ke atas atau terhadap mana-mana orang bagi mendorong atau memaksa orang itu mengundi atau tidak mengundi, atau oleh sebab orang itu telah mengundi atau tidak mengundi, dalam mana-mana pilihan raya, atau yang dengan melarikan pemilih atau pengundi, dengan dures atau apa-apa tipu daya atau muslihat menghindar atau menahan mana-mana pemilih atau pengundi daripada menjalankan hak mengundinya dengan bebas, atau yang dengan yang dengan itu memaksa, mendorong, atau mendesak mana-mana pemilih atau pengundi sama ada memberi atau tidak memberi undinya dalam mana-mana pilihan raya, atau yang secara langsung atau tidak langsung mengganggu atau cuba mengganggu mana-mana orang daripada menjalankan hak pemilihannya dengan bebas adalah bersalah atas kesalahan pengaruh tak wajar.

Sementara menunggu Suruhanjaya Pilihanraya menyiasat dan membuat laporan polis mengenai kes ini, kami menyeru Chew supaya menarik balik kenyataan beliau dan memohon maaf. Beliau mesti mengecam dengan sekeras-kerasnya sebarang kes keganasan politik. Pengundi berhak memilih mana-mana calon atau parti pilihan mereka dalam suasana yang bebas dari unsur-unsur ugutan dan intimidasi.

Kami juga menyeru YAB PM Dato’ Seri Abdullah Badawi untuk menafikan sebarang kaitan antara kerajaan dan partinya dengan kenyataan Chew yang berpotensi menakutkan pengundi. YAB juga harus mengutuk dengan sepenuhnya sebarang ugutan dan ancaman ke atas pengundi.

Kita tidak boleh biarkan Malaysia senasib negara di mana keganasan politik berleluasa eperti Pakistan. Kita tidak boleh biarkan mana-mana pihak bermain dengan api. Kita mesti menolak dengan sepenuhnya sesiapa yang cuba menggunakan insiden pahit Mei 13 untuk mengancam rakyat Malaysia.

Individu-individu atau badan-badan masyarakat madani yang pro-demokrasi diminta menyokong kenyataan ini dengan memaparkannya di premis, kenderaan atau mukasurat pertama blog atau laman web mereka, sebagai tanda pengiktirafan, sehinggalah Chew menarik balik kenyataannya dan meminta maaf.

  2. Shame on her. I expected statements like this from UMNO lowlifes, but from MCA? It looks like her accident did her head more harm than good.

    nat: i’m glad she escaped her accident ok. it should be noted that this has basically *always* been MCA’s line - they used it in Machap and Ijok too.

  3. desperados engaging in desperate measures. is that how MCA fish for votes? This is really despicable, worse than the corrupt acts perpetrated by MCA, one of which is the scandalous Port Klang Fleece Trade Zone.

  5. Now I know how shallow our MCA leaders are. If there are insufficient Chinese in the BN, it is the fault of your own members’ non-involvement in the daily running of the government. MCA is a non-entity in the BN anyway.
    YB Chew should be happy that the Chinese numbers dropping in the government means that there is an increase of Chinese in the Parliment. These Chinese really work for the Chinese whereas the MCA works only for themselves only.
